Privacy Policy

Introduction

This Privacy Policy applies to the websites, applications, and cloud-based services offered by WorkSeer Corporation and its subsidiaries (collectively, "WorkSeer," "we," "our," or "us"). In some cases, a specific product or affiliate may provide a distinct privacy notice; where that occurs, the affiliate's notice will take precedence while you are interacting with that service.

At WorkSeer, we take the privacy of our users seriously. We are committed to protecting the personal information of:

  • Users – individuals who register for or access our Services,
  • Customers – business entities that our Users represent, and
  • Visitors – individuals who browse our websites or interact with our Services without registering.

Our Services are designed for use by adults and are not directed to anyone under the age of 18, and WorkSeer does not knowingly collect personal information from children under this age. If we learn that we have inadvertently collected personal information from a child under 18, we will take steps to delete it promptly.

This Privacy Policy explains how we collect, use, share, and safeguard personal information when you engage with our websites or Services, or when WorkSeer otherwise receives information about you. Please note that this Policy applies to personal data only. Other categories of data, including business or compliance data, are governed by the terms of your agreement with WorkSeer and related documentation.

WorkSeer does not sell or rent or share personal information. We will not share your information with third parties for their independent commercial purposes. Data may be shared only in limited circumstances, such as to fulfill transactions you authorize, enable integrations you request, or comply with legal obligations.

Information We Collect

WorkSeer Corporation collects personal and business information from Users, Customers, and Visitors to provide, maintain, and improve our Services. This information is generally provided directly by you when creating an account, entering into a business relationship with us, or engaging with our team through email, phone, or our websites. Such information may include your first and last name, email address, phone number, country, company affiliation, and role within your organization. In certain cases, we may also collect business details such as invoicing records, payment information, or tax identification numbers in connection with customer accounts or billing activities.

In addition to account details, Customers and Users may upload or transmit business data through the WorkSeer platform as part of their use of our Services. This may include information about transactions, products, partners, and compliance documentation that is necessary for performing screening, processing, and other compliance-related functions. WorkSeer processes this information solely on behalf of our Customers and in accordance with applicable agreements.

When you communicate with WorkSeer (for example, by contacting our support team, providing feedback, or participating in surveys) we collect the information you choose to share, including the content of your communications and any attachments. We may also maintain records of this correspondence in order to respond to your inquiries, improve service quality, and enhance our products and Services.

Visitor Data

WorkSeer Corporation may collect information voluntarily provided by Visitors who choose to use the contact section of our website. This information, such as name, email address, and the content of the inquiry, is used solely for the purpose of responding to the request and will not be used for unrelated purposes.

Cookies and Tracking Technologies

Our websites and applications may use cookies, log files, and similar technologies to improve functionality, analyze usage, and provide a more personalized experience. Cookies are small files stored on your device that help us recognize repeat visitors, understand traffic patterns, and improve our Services. You may configure your browser to refuse cookies or to alert you when cookies are being sent; however, some features of our Services may not function properly without them. Where required by law, we will obtain your consent before placing non-essential cookies.

User and Visitor Information Supplementation

In addition to the information you provide directly, WorkSeer may receive limited business contact details about Users or Customers from third-party sources. These sources may include publicly available records, business partners, or service providers engaged to support our operations. For example, we may obtain updated business contact information to ensure that our records remain accurate or receive candidate information from recruiting agencies in connection with hiring activities.

If you provide us with personal information about others, or if others provide us with your information, we will use that information only for the specific purpose for which it was supplied—for instance, to establish or maintain a business relationship, deliver our Services, or complete a transaction that you or your organization has requested.

How We Use Information

WorkSeer Corporation uses personal and business information solely to deliver our Services, support our Customers, and fulfill our contractual and legal responsibilities. The information we collect allows us to authenticate Users, establish and manage accounts, and provide secure access to the platform. It also enables us to deliver the compliance and screening services requested by our Customers, including the processing of transactions, partner data, and related documentation uploaded into the WorkSeer system.

We use contact and billing details to manage our commercial relationships, including invoicing, payment processing, and account administration. When Users or Visitors communicate with WorkSeer - whether for support, training, or general inquiries - we use the information provided to respond effectively, maintain service quality, and improve our customer support processes.

Information may also be used to protect the integrity and security of our Services. This includes monitoring for fraudulent or unauthorized activity, investigating potential misuse, and taking steps to safeguard sensitive business and compliance data. By analyzing service usage and customer feedback, we also gain insights that help us optimize platform performance, develop new features, and enhance the overall user experience.

WorkSeer may provide Users and Customers with important communications about our Services, such as security alerts, policy updates, or product announcements. In some cases, we may also send information about new features or offerings; where required, we will obtain consent, and you may opt out of promotional messages at any time.

We do not use personal information for purposes unrelated to the delivery, security, or lawful operation of our Services. We do not sell, rent, or otherwise disclose personal data for commercial gain. Any processing outside the scope described in this Privacy Policy will occur only with your explicit consent or as required by law.

Use of Customer and User Data

WorkSeer Corporation processes the information provided by Users and Customers strictly for the purposes for which it was supplied and in connection with the Services delivered by WorkSeer. Data submitted to the platform (such as transaction records, partner details, compliance documentation, or other business information) is used solely to perform the screening, processing, and compliance functions requested by the Customer.

WorkSeer does not use Customer or User data for purposes unrelated to the Services, and such data is not disclosed to third parties except as necessary to fulfill contractual obligations or as required by law. All processing of Customer and User data is carried out in accordance with the applicable agreement between WorkSeer and the Customer and in compliance with applicable data protection laws.

Third-Party Service Providers and Subprocessors

To deliver our Services, WorkSeer engages trusted third-party service providers ("subprocessors") that perform functions such as cloud hosting, payment processing, customer support, and security monitoring. These providers may have access to limited personal information solely for the purpose of performing their contracted services on our behalf and are bound by strict contractual obligations to protect that information. A current list of subprocessors engaged by WorkSeer is available upon request.

Data Storage and Security

WorkSeer Corporation is committed to protecting the confidentiality, integrity, and availability of the information entrusted to us. We store all personal and business data in secure cloud infrastructure that employs industry-standard safeguards, including encryption, access restrictions, firewalls, and secure environments for personally identifiable information. Data is encrypted both in transit and at rest, and access is limited to authorized personnel who require it to perform their job responsibilities.

We maintain administrative, technical, and physical security measures designed to prevent unauthorized access, disclosure, alteration, or loss of information. Our systems are continuously monitored for vulnerabilities and suspicious activity, and we regularly review and update our controls to adapt to emerging threats.

WorkSeer enforces a comprehensive set of security policies, including Data Classification, Data Retention, and Endpoint Security, to protect the proprietary and confidential information of our Customers and Users. These policies address how information is classified, stored, and shared, as well as procedures for physical facility access and general security awareness across our workforce.

To provide independent assurance, WorkSeer aligns its security practices with recognized industry standards and undergoes regular third-party assessments, including SOC 2 audits, to validate the effectiveness of our controls. While no system can guarantee absolute security, WorkSeer employs a defense-in-depth approach and is committed to continuously strengthening our security posture.

Data Breach Notification

In the unlikely event of a data breach that affects your personal information, WorkSeer will notify affected Customers and Users without undue delay, and in accordance with applicable data protection laws. Notifications will include details of the nature of the breach, the categories of information involved, and steps we are taking to mitigate potential harm.

Data Retention

WorkSeer Corporation retains personal and business information only for as long as it is reasonably necessary to fulfill the purposes for which it was collected, to provide the Services, and to meet our contractual and legal obligations. The specific retention period will vary depending on the nature of the information, the context in which it was obtained, and the requirements of applicable laws and regulations.

With respect to information that Customers and Users upload to the WorkSeer platform, such data is processed and stored exclusively for the purpose of delivering the Services under the governing agreement between WorkSeer and the Customer. Upon termination of the Services, or upon a Customer's written request, WorkSeer will delete or return such data within a commercially reasonable period, subject to any legal, regulatory, or contractual obligations requiring further retention.

When information is no longer required for the purposes set out above, WorkSeer will take appropriate steps to ensure that it is securely deleted, anonymized, or otherwise rendered unusable in accordance with industry standards. WorkSeer maintains and enforces internal policies, including a Data Retention and Disposal Policy, to ensure that all data is handled in a consistent, secure, and legally compliant manner throughout its lifecycle.

International Data Transfers

WorkSeer Corporation operates globally. As a result, personal information may be transferred to, stored in, or processed in countries outside of your country of residence, including jurisdictions that may not provide the same level of data protection as your home country. Where we transfer personal information internationally, we implement appropriate safeguards - such as standard contractual clauses approved by regulators or other lawful mechanisms - to ensure that your information remains protected.

Changes to This Policy

WorkSeer Corporation may update this Privacy Policy from time to time to reflect changes in our business practices, legal or regulatory requirements, or the features of our Services. We encourage you to periodically review this Privacy Policy. When we make material changes, we will provide appropriate notice to our Customers and Users, such as by posting a revised version on our website, updating the "Last Updated" date at the top of this page, or, where required by law, delivering direct notification by email or through the Services.

We encourage all Users and Customers to review this Privacy Policy periodically to remain informed about how WorkSeer protects and uses personal and business information. Continued use of the Services after the effective date of an updated Privacy Policy constitutes acceptance of the revised terms.
